Terms and Conditions
These Terms and Conditions (Terms) govern your use of the Equazen website (Site) and your relationship with Equazen. (Equazen is a trading name of Soho Flordis UK Ltd, we or us). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the Site. Please note that to use any of the services provided on the Site, you are required to register as an authorised user on the site.
1. Use of the Site
1.1 The Site is provided to you free of charge for your personal use subject to these Terms and Conditions. By using the Site you agree to be bound by these Terms and Conditions.
1.2 These Terms govern your use of the Site.
1.3 All orders and purchases made on the Site will also be governed by the Product Terms.
THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.
We may update these Terms from time to time and any changes will be notified to you via the e-mail address provided by you on registration. The changes will apply to the use of the Site after we have given notice. If you do not wish to accept the new Terms you should not continue to use the Site. If you continue to use the Site after the date on which the change comes into effect, your use of the Site indicates your agreement to be bound by the new Terms.
3.1 You must ensure that the details provided by you on registration or at any time are correct and complete.
3.2 You must inform us immediately of any changes to the information that you provided when registering by updating your personal details.
4. Password and security
4.1 When you register to use the Site you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us by contacting Customer Services (see below for contact details) immediately. Equazen does not store previous payment details within your login to minimise misuse of accounts.
4.2 If Equazen has reason to believe that there is likely to be a breach of security or misuse of the Site, we may require you to change your password or we may suspend your account in accordance with paragraph 12 below.
5. Promotional offers
5.1 Certain offers are only available for a limited period and while stocks last. If your order is received after the offer period or the goods are no longer available at the offer price, we will notify you before we dispatch the goods.
5.2 Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price. Your statutory rights are not affected.
5.3 No offer can be used in conjunction with any other offer.
6. Excluded Services
The services provided by the Site do not include the provision of computer or other necessary equipment to access the Site. To use the Site you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.
7. Intellectual property
7.1 The content of the Site is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Site without written permission from Equazen.
7.2 No licence is granted to you in these Terms and Conditions to use any trade mark of Equazen affiliated companies including, without limitation, the trade marks eye q™, qarma™, mumomega™, cardiozen™ and equavision™.
8.1 You may not use the Site for any of the following purposes:
a) disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material
b) transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice
c) gaining unauthorised access to other computer systems
d) interfering with any other person's use or enjoyment of the Site
e) breaching any laws concerning the use of public telecommunications networks
f) interfering or disrupting networks or web sites connected to the Site
g) making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner
h) Equazen reserves the right to refuse to post material on the Site or to remove material already posted on the Site
8.2 You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgement by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:
a) any claim by any third party that the use of the Site by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice
b) any claim by any third party that the use of the Site by you infringes that third party's copyright or other intellectual property rights of whatever nature
c) any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the Site by you
9. Availability of the Site
9.1 Although Equazen aims to offer you the best service possible, Equazen makes no promise that the services at the Site will meet your requirements. Equazen cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to the Customer Services (see below for contact details) or by email at email@example.com and we will attempt to correct the fault as soon as we reasonably can.
9.2 Your access to the Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Equazen will attempt to restore the service as soon as it reasonably can.
10. Equazen reserves the right to suspend or cancel your registration
10.1 Equazen may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.
10.2 You can cancel this agreement at any time by informing us in writing. If you do so, you must stop using the Site.
10.3 The suspension or cancellation of your registration and your right to use the Site shall not affect either party's rights or liabilities.
10.4 Paragraphs 9,10,13,14,17 and 18 of these Terms and Conditions shall survive cancellation.
11. Equazen's liability
11.1 The Site is provided by Equazen without any warranties or guarantees. You must bear the risks associated with the use of the Internet.
11.2 The Site provides content from other Internet sites or resources and while Equazen tries to ensure that material included on the Site is correct, reputable and of high quality, it cannot accept responsibility if this is not the case. Equazen will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Site. If Equazen is informed of any inaccuracies in the material on the Site we will attempt to correct the inaccuracies as soon as we reasonably can.
11.3 In particular, we disclaim all liabilities in connection with the following:
a) incompatibility of the Site with any of your equipment, software or telecommunications links
b) technical problems including errors or interruptions of the Site
c) unsuitability, unreliability or inaccuracy of the Site
d) inadequacy of the Site to meet your requirements
11.4 To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Site.
11.5 Nothing in paragraph 12 applies to Equazen's liability in respect of products sold through this Site.
11.6 Nothing in these Terms and Conditions shall exclude Equazen's liability for personal injury or death caused by its negligence.
11.7 Our acceptance of an order takes place at the time you place the order. We do not charge for any item until it is dispatched.
13. Third Party Websites
As a convenience to Equazen customers, the Site includes links to other websites or material, which are beyond its control. Equazen is not responsible for content on the Internet or World Wide Web pages.
14. Applicable Law
These Terms shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.
15. International Use
Equazen makes no promise that materials on the Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.
16.1 Expiry Date on Payment Card
Please ensure that the expiry date of your payment card is at least 3 days after the day that you place an order. Payment is taken at the point of dispatching the goods and in the event that the payment card has expired we will be unable to take payment and fulfil your order.
16.2 Shipping and Handling
Equazen uses Royal Mail 1st class post to send out your order. This stands for all shipments in the UK and International. Delivery charges are as follows: UK: £2. Equazen is pleased to offer UK loyal customers free delivery on orders worth £40 and over. EU: £10 Rest of World: £14 Our delivery charges will be calculated automatically based on location. 16.3 Delivery Schedule
We process your order as soon as it is placed. Products are then delivered straight into the Royal Mail system on the evening of despatch. Once the package has been despatched, we are unable to control the delivery process, however we will do whatever we can to rectify any problems caused by delayed delivery. Equazen is not however liable for any delivery problems as they are beyond our control.
Under normal circumstances, in the UK you can expect to receive your goods within 7 working days. The delivery timings for international orders will vary according to location, but goods are generally received within 10 working days for Europe, and 14 working days elsewhere.
16.4 Back Orders
If your item is not in stock, we will back order it for you. You will always be emailed with the option to cancel your order if you would rather not wait.
16.5 Tax Charges
For orders made from the UK or the European Union, 20.0% VAT is included. If you have correctly stated your delivery and invoice addresses, and your order does not qualify for VAT, this will be removed prior to charging. Equazen is not responsible for import duties in your country, and so we would suggest you investigate fully the relevant tariffs before purchasing.
16.6 Credit Card Security
Equazen uses Secure Trading as its payment service provider. We know of no documented cases of credit card fraud using our Internet shopping system. All credit card numbers undergo 128 bit encryption. For further details, please visit www.securetrading.com.
Equazen is confident of the quality of its pharmaceutical-grade products, which have been subject to strict Quality Control procedures throughout the manufacturing process. However, if you find the product unsuitable, we will happily arrange a replacement. If the product you have purchased is faulty, you are entitled to a refund or replacement. Requests for refunds/replacements must be accompanied by a till receipt where products have not been purchased at the Equazen Online Shop. All this requires is for you to complete the returns form included with your order. Equazen does not disclose any information about our customers to third parties. Cookies may be used on this shopping site, but only to keep track of the contents of your shopping cart once you have selected an item. The operation of this site does not depend upon cookies.
16.9 General Notice
Equazen's products are exceptional nutritional supplements that are manufactured to a pharmaceutical standard. However, we always recommend you ask your doctor or pharmacist if you need medical advice or have any specific questions about supplementation with long chain fatty acids before commencing supplementation.
16.10 To pay by cheque
Please make cheques payable to 'Equazen'. Please send cheque to Equazen Customer Services, 16a St Marys Street, Wallingford, Oxfordshire, OX10 0EW. Please ensure that the total sum of the cheque includes delivery charges. Remember to include a note indicating which product, pack size and quantity you would like to purchase together with the delivery address.
17.1 You may not assign, sub-license or otherwise transfer any of your rights under these Terms.
17.2 If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
17.3 If you breach these Terms and Equazen ignores this, Equazen will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms.
17.4 Equazen shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.
20.0 A person who is not a party to these Terms shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
17.6 These Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.
17.7 If any of these Terms are held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms which will continue to be valid and enforceable to the fullest extent permitted by law.
